Real Changes Needed in Healthcare Policy
1. Ron Paul's Health Freedom Act (HR 3395)
- Presently the FDA blocks an enormous quantity of truthful information concerning the effects of nutrients and foods on disease from reaching consumers.
- Under the Health Freedom Act, the FDA may not prohibit any statement concerning a nutrient affecting a disease (including treatment effects) from being made in the market and may only act against a statement once made if it possesses clear and convincing evidence that the statement is false.
- The essential purpose of the First Amendment is to disarm the federal government of the power to impose a prior restraint on speech.
- The FDA has imposed a prior restraint for decades to the health detriment of the public. This bill removes FDA's power of prior restraint over all nutrient-disease relationship claims.
- Passage of the Health Freedom Act will restore constitutional governance by reasserting the supremacy of the First Amendment over the Food and Drug Administration.
- The prior restraint barrier is removed by the Health Freedom Act, and the Act preserves the power of the government to prosecute those who communicate falsehood.
2. Ron Paul's Congressional Responsibility and Accountability Act (HR 3396)
- This bill addresses the roughly 90% of federal government law that is not enacted by Congress, as is mandated in the Constitution under the non-delegation doctrine, but by unelected bureaucratic agencies such as the FDA and FTC.
- As such, it would prohibit any law created by these agencies from being enacted without first being passed by Congress in concordance with Article I of the Constitution.
- HR 3396 will restore constitutional government by returning the responsibility of legislating law to Congress which will in turn protect the public from rogue federal agencies who tend to overstep their bounds and tyrannize the people.
3. Ron Paul's Health Information Protection Act (HR 3394)
- This bill prevents the Federal Trade Commission from taking action against any advertiser that communicates a health benefit for a product unless the FTC first establishes based on clear and convincing evidence that the statement made is false and that its communication causes harm to the public.
- Presently, the FTC reverses the Fifth Amendment burden of proof on the government when it charges advertisers with deceptive advertising and then demands that they prove their speech true based on contemporaneously held documentation or be deemed to have advertised deceptively.
- The Fifth Amendment requires that FTC bear the burden of proving advertising deceptive. It may not constitutionally shift the burden to the advertiser to prove its statements not deceptive.
- The First Amendment requires that FTC not act against speech unless the speech is probably false.
- The FTC may not constitutionally accuse a party of false advertising yet lack proof that the advertising is false and condemn advertising based on an absence of documentation concerning the truth of the statement rather than the presence of evidence establishing the falsity of the statement.
4. Ron Paul's Comprehensive Health Care Reform Act (HR 1495)
- Tell Congress to give Americans control over their health care by giving them control over their health care dollar via tax credits and deductions similar to those outlined in HR 1496.
5. Ron Paul's Protect Patients and Physicians Privacy Act (HR 2630)
- Ask your congressman to protect privacy rights by allowing patients and physicians to opt-out of any government-mandated or funded system of electronic health care records, and to repeal the federal law creating an "unique patient identifier" by adopting the policies contained in HR 2630.
6. Ron Paul's Sunlight Rule (HR 216)
- The Sunlight Rule prohibits any piece of legislation from being brought before the House of Representatives unless it has been available to read for at least 10 days.

Iowa senator Tom Harkin, newly empowered to investigate health matters as chairman of the Senate Health, Education, Labor and Pensions Committee, promised on Monday to probe deeply into any potential links between cellphone use and cancer.
Harkin, who took over the committee earlier this month after the death of Massachusetts Senator Edward Kennedy, said he was concerned no one has been able to prove cellphones do not cause cancer.

9/12/09: Two thousand schoolgirls suffer suspected ill-effects from cervical cancer vaccine
Thousands of schoolgirls have suffered suspected adverse reactions to a controversial cervical cancer vaccine introduced by the Government.
Doctors' reports show that girls of 12 and 13 have experienced convulsions, fever and paralysis after being given the vaccine, which is now administered in schools as part of efforts to prevent women developing cancer.
Others suffered nausea, muscle weakness, dizziness and blurred vision, according to a special report drawn up by drug safety watchdogs.

Teen facing deportation for refusing unneeded meds for STD
The controversial medication Gardasil created and marketed by Merck & Co. to battle a sexually transmitted disease is causing problems for a Florida teenager: It could cost her U.S. citizenship.
Simone Davis, born in 1992 in Britain, was abandoned by her parents and adopted at age 3 by Jean Davis, her paternal grandmother, who then married and moved to Florida, ABC News reported.
However, her adoption in Britain wasn't recognized in the U.S., the report said, so the process was begun again in the U.S. The 17-year-old was on track for citizenship, attendance at Pensacola Christian College and a career as a teacher, until she ran into Gardasil.

Dear President Obama,
Thank you for all you are trying to do to truly change and improve our society. Because of your willingness to fight for real change, I am encouraged to write and urge you to take bold action and include a campaign for a "Healthier Way of Eating" (as part of a healthier lifestyle) in your universal healthcare plan. Promoting a healthier way of eating will provide Americans with the most powerful means to prevent disease and will save not only millions of lives, but billions of dollars in healthcare costs.
In the following pages of this letter, I want to demonstrate how you can cut as much as 50% of current healthcare costs over the next 4 years, without cutting healthcare services, by implementing a campaign to put a healthier way of eating at the forefront of healthcare. It is my conviction that the health of Americans and the national economy will be unable to overcome our current healthcare crisis. Without a campaign promoting a healthier way of eating, your universal healthcare plan will not be addressing one of the most significant underlying causes of disease and therefore its likelihood of either improving healthcare or cutting costs will be greatly reduced.
Scientific studies continue to demonstrate that among all lifestyle factors, no single factor is more important to our health than the food we eat. A campaign educating Americans about the benefits of eating healthier-and how to make healthy eating choices-would be a highly effective and relatively inexpensive means of improving our health.

At town halls around the country, many flooded by more protesters than event organizers anticipated, lawmakers returning from Washington are finding constituents don't want to listen; they want to be heard.
"Why won't you let the people speak?" shouted one protester in Tampa, FL, at a public forum where Rep. Cathy Castor, D-FL., attempted to pitch Obama's health care reform plan to her constituency.
8/3/09: Healthcare Plan Based Upon Economic Fantasy, Ron Paul
As the healthcare debate rages on, there is one reality that even the proponents of this hostile takeover of healthcare by government cannot ignore -- and that is money. The government simply does not have the money for a new, expansive, public healthcare plan. The country is in a deep recession that will deepen even further with the coming collapse of the commercial real estate market. The last thing we need is for government to increase and expand taxes to pay for another damaging, wasteful program. Foreigners are becoming less enthusiastic about buying our debt, and creating another open-ended welfare program when we cannot pay for what is already in place, will not help. Champions of socialized medicine want to tax the rich, tax businesses that already cannot afford to provide health plans to employees, and tax people who don’t want to participate in the government’s scheme by buying an approved healthcare plan. Presumably, all these taxes are to induce compliance. This is not freedom, nor will it improve healthcare.
